DIVORCE AND MOBILITY RESTRICTIONS
When a relationship ends, one parent may wish to move away. The parent may wish to move to another city, province, or country. Where parents have joint custody or joint guardianship of a child, bother parents must agree to the move. Where one parent does not agree to the relocation, the other parent requires an Order from the Court allowing the move. These sorts of applications are daunting and set a precedent for where your child may live in the future. There are numerous factors that need to be considered in determining whether such a mobility application is likely to be successful.
