Prenuptial and Postnuptial Agreements

Couples in Alberta can enter into agreements (known as prenuptial and postnuptial agreements) to protect their legal rights prior to or after marriage. These agreements are put into place to pre-emptively address matters such as support and property division if the relationship ends.

For these types of agreements to be legally binding, both parties must obtain independent legal advice and exchange full financial disclosure before signing.
