This situation, among others, may give rise to a claim for common law support. Common law supportis an ever-fluctuating area of the law and every situation is unique.

There is no automatic entitlement to common law support. If you are entitled to common law support, it becomes a question of how much should be payable and for how long.

Common law support calculations are informed by the Spousal Support Advisory Guidelines; however these Guidelines are not the law – they are only guidelines.
